IR35 victory against HMRC

IT contractor Mark Fitzpatrick has been cleared, by tribunal, of tax avoidance through his limited company.

After 7 years the IR35 dispute has finally reached a conclusion with Mark being cleared by the tribunal of tax avoidance whilst working at Airbus.

The lack of mutuality of obligation was an important factor in the decision. In its conclusion the tribunal noted that Airbus could cancel his contract without notice and there had been occasions where owing to system failures contractors were sent home without pay but employees had to remain on-site.
